आवेदकगण की ओर से अंतगर्त धारा 528 बी.एन.एस.एस./482 सी.आर.पी.सी भारतीय सुरक्षा संिहता के अंतगर्त यह आवेदन पत्र पिरवाद सं० 259/2026, अंतगर्त धारा 323/ 504/ 506/ 427/ 452 भा.दं.सं. थाना कमलगंज, िजला फरूर्खाबाद, मे ं एिडशनल चीफ जूडीिशयल मिजस्ट्रेट, कोटर् न. 08, फरूर्खाबाद द्वारा पािरत प्रसंज्ञान/तलबी आदेश िदनांक 17.01.2026 को रद्द करने एवं सम्पूणर् कायर्वाही को अपास्त करने के उद्देश्य से योिजत िकया गया है।

2 पिरवादी के िवद्वान अिधवक्ता संतोष चौबे द्वारा अपना वकालतनामा दािखल िकया गया उसे पत्रावली पर रखा जाए।

आवेदकगण के िवद्वान अिधवक्ता, पिरवादी के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

आवेदकगण के िवद्वान अिधवक्ता ने तकर् प्रस्तुत िकया िक उपर्युक्त मामलें में िवचारण न्यायालय द्वारा इस मामलें को पिरवाद के रूप में दजर् करते समय, तथ्यों का सम्यक पिरशीलन नहीं िकया गया तथा प्रश्नगत आदेश एक 'स्पीिकग' (सकारण) एवं तकर्संगत आदेश नहीं है तथा उक्त प्रश्नगत आदेश मात्र अनुमानों और कयासों के आधार पर पािरत िकया गया है। अतः उपरोक्त प्रश्नगत आदेश समुिचत िववेचना एवं तथ्यों पर आधािरत नहीं है। इसिलए, प्रश्नगत आदेश त्रुिटपूणर् है एवं अपास्त िकए जाने योग्य है।

पिरवादी के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता ने कथन िकया िक उक्त पिरवादी में जो चश्मदीद साक्षी है, उनके बयान आवेदक के िवद्वान अिधवक्ता द्वारा प्रश्नगत आदेश को अपास्त करने हेतु जो तकर् प्रस्तुत िकए गए वे बलहीन है। इसिलए, प्रश्नगत आदेश में हस्तक्षेप िकए जाने की कोई आवश्यकता प्रतीत नहीं हो रही है।

उभय पक्ष के िवद्वान अिधवक्तागण के तकोर्ं को श्रवणोपरांत एवं पत्रावली व प्रश्नगत आदेशों का सम्यक रूपेण पिरशीलन िकया उक्त पिरवाद में लगाये गया आरोप संज्ञेय अपराध का होना दिशत होता है और उन आरोपों की पुिष्ट अंतगर्त धारा 200 और 202 सी.आर.पी.सी. के तहत दजर् िकए गए बयानों से होती है, िजस आधार पर आवेदक के िखलाफ समन जारी िकया गया है। साथ ही धारा 482 सी.आर.पी.सी/धारा 528 बीएनएसएस के तहत अपनी शिक्त का प्रयोग करते हुए इस न्यायालय को आरोपों की सत्यता और साक्ष्यों की िवश्वसनीयता का आकलन करने की आवश्यकता नहीं है। अतः, समन आदेश और पिरणामी कायर्वाही को रद्द करने की प्राथर्ना अस्वीकृत की जाती है। उक्त को ध्यान में रखते हुए, यह आवेदन पत्र स्वीकार िकये जाने योग्य नहीं है। तद्नुसार, इसे अस्वीकार िकया जाता है।
