Parties settled their dispute out of their own free will; compromise deed dated 12.08.2025 (Annexure-6) was sent by the Court vide order dated 29.08.2025 to the trial court and verified vide order dated 19.09.2025 (Annexure SA-2). 1. Supplementary affidavit filed by learned counsel for the applicants today is taken on record.

2. Heard learned counsel for the applicants, learned A.G.A. for the Stateopposite party and learned counsel for the opposite party No.2.

3. The instant application under Section 482 Cr.P.C. (528 BNSS) has been filed by the applicants for quashing the chargesheet dated 24.12.2024 and impugned summoning order dated 14.05.2025 passed by the learned Chief Judicial Magistrate, Unnao as well as entire proceedings of Criminal Case No.12078 of 2025 arising out of concerning Case Crime No.937 of 2024, under Sections 115(2), 352, 351(3) BNS, Police Station Kotwali, District Unnao.

4. The parties, out of their own free will, have settled their dispute amicably and, in furtherance thereof, have filed a compromise deed dated 12.08.2025 annexed as Annexure-6 to the instant application. Thereafter, this Court, vide order 29.08.2025 passed in the instant application, sent the said compromise deed to the trial court with a direction to get the same verified and to submit a report.

5. Learned counsel for the parties have not disputed the fact that the parties have settled their dispute amicably and the compromise deed has been

verified by the trial Court vide order dated 19.09.2025, annexed as Annexure No.SA-2 to the Supplementary Affidavit filed today.

Considering the nature of the allegations levelled in the First Information Report and the fact that the parties have entered into a compromise which has been verified by the learned trial Court, this Court is of the considered opinion that no useful purpose shall be served by prolonging the proceedings of above mentioned case.

7. Accordingly, in view of the law laid down by Hon'ble Supreme Court in the case of Gian Singh vs State of Punjab and another reported in (2012) 10 SCC 303 , the entire proceedings of Criminal Case No.12078 of 2025 arising out of Case Crime No.937 of 2024, under Sections 115(2), 352, 351(3) BNS, Police Station Kotwali, District Unnao are hereby quashed.

8. The instant application under Section 482 Cr.P.C. (Section 528 B.N.S.S., 2023) is allowed.

9. Office is directed to send a copy of this order to the court concerned through e-mail/fax immediately for necessary compliance.
