यािचकाकतार् के िवद्वान अिधवक्ता श्री राजेन्द्र कुमार पाण्डेय तथा िवद्वान अपर शासकीय अिधवक्ता प्रथम श्री गणेश दत्त भट्ट को सुना तथा पत्रावली का अवलोकन िकया।

5 वषीर्य बालक अजुर्न यादव की तरफ से यह बन्दी प्रत्यक्षीकरण यािचका उसके िपता सूयर् प्रकाश िसह ने यह कहते हुए प्रस्तुत की है िक बालक अपनी माँ अंशु यादव (िवपक्षी संख्या 4) की अवैध अिभरक्षा में िनरुद्ध है।

यािचका के अिभकथनों के अनुसार सूयर् प्रकाश िसह तथा अंशु यादव का िववाह िदनांक 07.12.2017 को हुआ था। िजससे अजुर्न यादव का जन्म िदनांक 04.02.2021 को हुआ। अंशु यादव वषर् 2024 में अपना वैवािहक िनवास स्थान छोड़कर पुत्र अजुर्न यादव को अपने साथ लेकर चली गयी। अंशु यादव ने सूयर् प्रकाश िसह से िववाह िवच्छेद करने के िलए धारा 13(1)(1a) िहन्दू िववाह अिधिनयम के अंतगर्त एक वाद वषर् 2024 में प्रस्तुत िकया है।

िलिखत अनुदेशों के आधार पर यािचका का िवरोध करते हुए िवद्वान अपर शासकीय अिधवक्ता प्रथम ने कहा िक पित के द्वारा िकये जा रहे दुव्यर्वहार के कारण अंशु यादव अपने पित से अलग होकर मायके में आकर रहने लगी तथा उन्होंने िववाह िवच्छेद का वाद प्रस्तुत िकया है जो न्यायालय में िवचाराधीन है। अंशु यादव अपने पुत्र अजुर्न यादव का पालन पोषण अच्छे से कर रही हैं। िलिखत अनुदेशों की एक प्रित अिभलेख पर रखी जाती है।

उपरोक्त तथ्यों से यह प्रतीत होता है िक बालक के माता-िपता में वैवािहक मतभेद हैं िजस कारण से वषर् 2024 से ही बालक अपनी माँ के साथ स्थायी रूप से रह रहा है। बालक की माँ ने िववाह िवच्छेद का वाद प्रस्तुत िकया हुआ है। ऐसे में बालक अवैध अिभरक्षा में नहीं है।
