Heard Shri Dinesh Kumar Tiwari, the learned counsel for the petitioner, Shri G.D. Bhatt, the learned AGA-I and Shri Rahul Kumar Singh, Advocate who has filed his vakalatnama on behalf of the respondent No.5, which is taken on record.

The instant writ petition seeking issuance of a writ of habeas corpus has been filed by the alleged minor detenue- Chandni through her mother- Anita, alleging that the opposite party No.4 threatened the detenue at the Hotel of Shailendra Singh and under threat, got her married to the opposite party No.5 at a temple on 16.03.2026. The mother of the alleged detenue gave an application to the Station House Officer, Inayat Nagar but he did not lodge a First Information Report. Thereafter, she filed a complaint on IGRS portal but to no avail.

The learned AGA-I has obtained written instructions and a copy whereof is taken on record.

The alleged detenue Chandni and the opposite party No.5 Amit Kumar have appeared before this Court on their own and a copy of the Aadhar Card of the alleged detenue has been produced by the learned counsel for the petitioner from which it appears that the person who has appeared before this Court claiming herself to be Chandni, is the alleged detenue Chandni herself.

In the written instructions provided by the police, it has been stated that the petitioner herself had performed the marriage of her daughter Chandni in Durgan Mandir, Itagaon. A copy of the footage taken from the CCTV

camera installed in the temple and some other photographs and videos of the marriage ceremony have been provided to the Court in a pen-drive and the Court has perused the photographs and the videos after inserting the pendrive in its computer and playing the videos. After perusal, the pen-drive has been returned to the learned AGA-I and the instructions and some photographs annexed with the same are kept on record.

The instructions state that the wedding ceremony has been performed by the priest of the temple Shri Arun Shashtri. The police had denied that the complainant had given any application in the police station on 16.03.2026. The instructions further state that the alleged detenue is residing in her matrimonial home happily.

Regarding the allegation that the alleged detenue is minor, the instructions state that the mother of the detenue herself has performed her marriage.

The alleged detenue Chandni has stated that she has married the opposite party No.5 Amit Kumar willingly, without any influence or caution. Her parents and maternal grand-father had attended the wedding ceremony. She has stated that the allegations levelled in the petition filed by her mother are false.

From the aforesaid facts, the allegation of illegal detention of the alleged detenue is not made out.

The petition lacks merit and the same is hereby dismissed .
