Heard learned counsel for the revisionist and the learned A.G.A. for the State.

Under challenge is the impugned order dated 27.11.2025 passed by the Learned Additional Sessions Judge, Court No. 9, Ghaziabad, in Session Trial No. 836 of 2024 (State vs. Lavish Sharma), arising out of Case Crime No. 524 of 2024, under Sections 115(2), 352, 351(3), 109, and 126(2) of the B.N.S. and Sections 3/25/27 of the Arms Act, Police Station Muradnagar, District Ghaziabad, whereby the discharge application filed by the revisionist was rejected.

Learned counsel for the revisionist has submitted that the discharge application filed by the revisionist has been illegally rejected by the learned trial court vide the impugned order dated 27.11.2025. He further submitted that the matter arises out of a family dispute. The FIR has been lodged by his cousin, and there is neither any injury nor any medical examination report.

Learned A.G.A. has opposed the revision and contended that the charge sheet has been filed against the revisionist under Sections 115(2), 352, 351(3), 109, and 126(2) of the B.N.S. and Sections 3/25/27 of the Arms Act. The FIR was lodged by opposite party no. 2 on 10.08.2024 at 20:42 hours, alleging therein that on 09.08.2024 at around 7:30 p.m., there was an altercation regarding parking of a vehicle on the road, during which his younger brother, Paurush Sharma, was beaten by Lavish Sharma and Vasu Sharma. Thereafter, the people present in the village intervened and resolved the matter among themselves.

It is further alleged that on 10.08.2024 at around 10:30 a.m., Lavish stopped the complainant/opposite party no. 2 outside the house of Rakesh Sharma and abused him, which he protested against. He was then sent home by Tekram Sharma, Lokish Sharma, and Shivdutt Sharma, who were present there. As soon as he left for his house, Lavish allegedly fired a shot from an illegal pistol at him from his terrace, which passed close to him. The second

shot passed close to his brother. Lavish was allegedly present along with his cousin brother Vasu, and the illegal pistol was allegedly provided by Mohit.

Upon completion of the investigation, it was found that the offence had been committed by the revisionist, and there is consistent material on record indicating his involvement. After due investigation, a charge sheet has been filed under the aforesaid sections.

A perusal of the record reveals that the learned trial court has passed a detailed and well-reasoned order supported by the relevant legal provisions. At this stage, a meticulous appreciation of evidence or conducting a minitrial would not be justified. The material on record discloses more than a prima facie case against the revisionist, as evidenced by the filing of the charge sheet. This Court finds no merit in the submissions advanced by the learned counsel for the revisionist.

In view of the foregoing, the criminal revision lacks merit and is dismissed accordingly.
