Heard learned counsel for the petitioner and learned A.G.A. for the State.

In view of the contrary prayer made in the affidavit and the second prayer being rendered infructuous on account of grant of anticipatory bail to the accused persons, learned A.G.A. has raised preliminary objection regarding maintainability of this petition.

Faced with the above, learned counsel for the petitioner submits that the petition may be dismissed as not pressed with liberty to file the same afresh by making proper prayers, if occasion arises.

Dismissed accordingly as not pressed with the aforesaid liberty.
