Heard learned counsel for the petitioners, learned A.G.A. for the State and perused the record.

Learned counsel for the petitioners has submitted that the petitioners are wholly innocent and have been falsely implicated in the instant case due to ulterior motive.

It is next submitted that the offences, complained of, in the instant case are non-cognizable yet the first information report has been lodged treating them to be cognizable offences, and as such, the impugned first information report could not have been registered, and is bad in law and liable to be quashed.

Matter requires consideration.

Issue notice to respondent no. 4 returnable within four weeks.

Steps be taken within a week.

Learned A.G.A. may also file counter affidavit within the said period. Rejoinder affidavit, if any, may be filed within one week thereafter.

List this case on 20.05.2026.

Till then, the petitioners shall not be arrested in pursuance of the impugned F.I.R. dated 29.07.2025 giving rise to Case Crime No. 352 of 2025, under Sections 115(2), 352 and 351(3) B.N.S., Police Station- Shahi, DistrictBareilly.
