Heard learned counsel for the appellant, learned A.G.A. for the State respondent no.1 and perused the record.

Instant criminal appeal, under Section 14(A)(1) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, has been preferred against the summoning order dated 27/11/2025, passed by the learned Special Judge, S.C./S.T. Act, Raebareli, whereby the appellant has been summoned in S.ST. No.1738 of 2025, Crime No.389 of 2024, State versus Dilip Kumar Shukla, under Sections 323, 504, 506, 406 I.P.C. and Section 3(1)(Da)(Dha) of the S.C./S.T. Act, Police Station - Shivgarh, Dstrict Raebareli.

Learned counsel for the appellant submitted that as per the F.I.R. version, the case was lodged on the order of the learned Special Judge, S.C./S.T. Act, on an application under Section 173(4)(B) Cr.P.C., at the instance of the informant, Virendra Kumar. There are allegations of criminal breach of peace, voluntarily causing hurt, intentional insult and criminal intimidation against the appellant in the F.I.R. However, no case is made out against the appellant under Section 3(1)(Da)(Dha) the S.C./S.T. (PA) Act. There is no injury in support of the F.I.R. version. During the investigation, no evidence was collected by the investigation officer that the informant, who has stated that he is a palledar (laborer), has withdrawn total of Rs. 91,500/- on various dates from his credit card

and handed it over to the appellant. The informant has stated in his statement under Section 161 Cr.P.C. that he had credited Rs.65,000/- to the appellant as a hand loan, which was kept in his house out of Rs.75,000 borrowed from K.C.C. There is inconsistency in the statement of the informant, both in his F.I.R. version and his statement under Section 161 Cr.P.C.

Issue notice to the respondent no.2, returnable at the early date, through CJM concerned.

Steps be taken within 10 working days.

List on 21/04/2026 as fresh.

Till the next date of listing, no coercive process shall be taken against the appellant.
