Heard learned Counsel for the appellant, learned A.G.A. appearing on behalf of the State and perused the record.

Counter affidavit filed today is taken on record.

This Criminal Appeal has been filed under Section 18 of the U.P. Gangster and Anti-Social Activities (Prevention Act), 1986 against the order dated 17.06.2025 passed by learned Special Judge, Gangster Act, Ambedkar Nagar in Criminal Misc. Case No.186/2022 (State Vs. Moti Lal Gupta) as well as against the order dated 13.05.2022 passed by District Magistrate, Ambedkar Nagar.

Learned counsel for the appellant submits that by the impugned order dated 13.05.2022 passed by the District Magistrate, Ambedkar Nagar, which has been affirmed by learned Special Judge, Gangster Act, Ambedkar Nagar by order dated 17.06.2025, certain properties acquired by the appellant have been attached on the ground that these properties were acquired by the appellant by engaging himself in criminal activities. He also submits that the appellant has wrongly termed as Gang Leader in the gang chart attached with Case Crime No.133 of 2021, Police Station Jaitpur, Ambedkar Nagar. In the said F.I.R. bearing Case Crime No.133 of 2021, ten other persons are also made accused. The first case registered against the appellant is in the year 2016, but in the said case he was not convicted. All other cases registered against the appellant is in the year

2021 and onwards, which have been explained by him in the supplementary affidavit.

Learned counsel for the appellant further submits that the properties in question which have been acquired by him are prior to 2020. Thus, it may not be said that such properties were acquired by indulging in criminal activities and some interim measure may be granted to the appellant restraining sale or auction of the properties attached consequent upon the impugned order.

Learned A.G.A. has opposed the prayer for interim relief and submitted that the criminal antecedents has not been explained by the appellant and source of money by which said properties were acquired by him has also not been disclosed.

Till the next date of listing, respondents are directed to maintain status quo regarding property in question.
