Present contempt application has been preferred for alleged non-compliance of the judgment and order dated 17.12.2025 passed in Writ A No. 14418 of 2025. The relevant para of the said judgment is being reproduced hereinbelow:-
"Be that as it may, without entering into merits of the case, the petitioner is given liberty to move fresh representation before the respondent no.3/Director, Kamla Nehru Institute of Technology, Sultanpur for execution of the recommendation of promotion committee, within the period of three days and if such representation is moved that shall be considered by the respondent no.3, within further period of two weeks, in accordance with law"
After arguing at some length on the merits of the decision taken on the representation of the applicant, which cannot be seen in the present contempt proceedings as the direction of the Writ Court is only to decide the representation of the applicant, learned counsel for the applicant has submitted that applicant may be permitted to withdraw the present contempt application and the same may be dismissed as not pressed with liberty to the applicant to avail the remedy, as may be permissible under the law.
As such, the present contempt application is dismissed as not pressed.
It is always open to the applicant to avail the remedies, as may be permissible under the law.
