The writ Court on 26.9.2024 while disposing of Writ-C No. 28095 of 2024 had required the opposite party to pass final assessment order and passed the following order;

"1. The instant petition has been filed praying for quashing of the demand notice dated 10.04.2024 and the notice of provisional assessment dated 11.05.2024 issued by respondent no.2 in respect of an alleged incident of unauthorized use/theft of electricity by the petitioner.

2. Shri Chetan Chatterjee, learned counsel appearing on behalf of the Electricity Department submits that the recovery notice dated 10.04.2024 has been withdrawn. The petitioner has been issued a fresh notice of provisional assessment dated 11.05.2024 inviting objections and that the Authorities would pass order on final assessment, after considering the objection, as may be filed by the petitioner in response to the said notice.

3. Learned counsel for the petitioner points out that he has already filed objection against the notice of provisional assessment dated 11.05.2024 on 30.05.2024 (Annexure-9).

4. Having regard to the facts of the case and the submissions made, we dispose of the instant petition by providing that order of final assessment be passed strictly in accordance with the procedure prescribed, taking into consideration the objection of the petitioner. "

Learned counsel appearing for the opposite party informs the Court that opposite party no. 2 has been transferred and new officer Ashish Kumar Seth had joined as Executive Engineer, Ist, District Mau and he prays for further time to comply the order of writ Court.

This Court is surprised to note that more than 16 months have elapsed and the Executive Engineer, Ist, District Mau had failed to pass the final assessment order till date. This Court fails to understand for what the Executive Engineer, Ist, District Mau is waiting for, it seems that he has no respect for the orders of Court.

Sri Ashish Kumar Seth, Executive Engineer, Ist, District Mau, is directed to appear before this Court on 9.1.2026 and explain as to why contempt proceedings be not initiated against him.
