Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

Instant bail application has been filed with a prayer to release the applicant on bail during the trial in Case Crime No. 251 of 2025, under Sections 318(4), 338, 336(3), 340(20, 3(5) of BNS, Police Station- Kalyanpur, District Kanpur Nagar.

Contention of learned counsel for the applicant is that the applicant was not named in the FIR. Subsequently on the basis of information the applicant was arrested along with other co-accused namley Bablu Kumar, Prince Pandy and Dipanshu Sharma and mobile phone of the applicant was also taken away by the investigating agency. No incriminating material has been recovered from the applicant.

Learned AGA submitted that there is specific allegation against the applicant that he after engaging other co-accused Bablu Kumar and Dipanshu Sharma used to create false invoices through his bogus firm to avail the tax benefit under GST Act.

Learned AGA is directed to seeks specific instruction regarding creation of bogus firm by the applicant as well as other incriminating material recovered from his mobile and his office.
