Heard Sri Ajay Dubey, learned counsel for the applicant, Sri Birendra Pratap Singh, learned counsel for the State and perused the record.

This is the second bail application.

Learned counsel for the applicant submits that the first bail application of the applicant was got dismissed as withdrawn on the ground that criminal history of the applicant was reported by learned A.G.A. but the applicant has no criminal history. He places para-19 and 20 of the affidavit for the same. He submits that the said fact is incorrect.

Learned A.G.A. again submits that as per his instructions the applicant has criminal history of one case being Case Crime No. 240 of 2003, u/s 13 of Gambling Act, Police Station- Sasani, District Hathras.

Since there are rival submissions, learned A.G.A. shall seek specific instructions regarding the same by the next date positively and also seek clarification from the person who has sent instructions regarding the same along with the relevant documents of it.
