Heard Sri Amit Kumar Pandey, learned counsel for the applicant, Sri Roshan Kumar Singh, learned A.G.A. for the State and perused the record.

Instant bail application has been filed with a prayer to release the applicant on bail during the trial in Case Crime No. 185 of 2024, under Sections 305(2), 317(2) BNS, Police Station- Mansoorpur, District Muzaffarnagar.

Contention of learned counsel for the applicant is that on the basis of joint recovery of applicant and other co-accused persons, 14 motorcycles were shown to be recovered but the proceeding under Section 105 BNSS has not been followed regarding recording of recovery and preparation of fard. It is further submitted that co-accused Shadab having similar role to that of the applicant has been enlarged on bail by this Court in Criminal Misc. Bail Application No.3695 of 2026 vide order dated 05.01.2026. Therefore, the applicant is entitled to be released on bail on the ground of parity. He further submitted that the applicant has explained the criminal history of 11 cases in the accompanying affidavit.

On the other hand, learned A.G.A. for the State opposed the prayer for bail and submitted that the applicant has explained the criminal history of 11 cases though there are 15 cases against the applicant which have not been explained. It is further submitted that co-accused Shadab was having criminal history of six cases, whereas the applicant has criminal history of more than 15 cases, therefore, the applicant cannot claim parity with coaccused Shadab.

Considering the aforesaid submission and taking into account the fact that the applicant has not explained the criminal history of remaining four cases, he is directed to explain the criminal history of remaining four cases along with annexing the bail orders.

Put up this case as fresh in the week commencing 9th March, 2026.
