Bail Application No. 34202 of 2025 by which Uday Pratap Yadav sought bail in Case Crime No. 402/2025, Police Station Cantt, District Gorakhpur, registered under Sections 137(2), 64(1) and 351(3) of the Bharatiya Nyaya Sanhita and Sections 3/4 of the POCSO Act. Counsel for the applicant argued that the applicant was not named in the FIR and his name emerged only during investigation through the informant's statement; the victim's statements recorded under Sections 180 and 183 BNSS did not disclose the applicant's name; the victim had herself refused medical examination; she was not recovered from the applicant's protection or company; and the note left by her showed she had left her paternal home of her own accord, there being material contradictions between the FIR version, the victim's Section 180/183 BNSS statements and the medical examination report, which did not support the prosecution case. वतर्मान दािण्डक प्रकीणर् जमानत प्राथर्ना पत्र आवेदक की ओर से मु०अ०सं० 402/2025 , अन्तगर्त धारा 137(2), 64(1), 351(3) भारतीय न्याय संिहता एवं धारा 3/4 पाक्सो एक्ट , थाना कैंट , िजला गोरखपुर में जमानत पर मुक्त करने हेतु प्रस्तुत िकया गया है।

कायार्लय आख्या, िदनांिकत 05.12.2025 के अनुसार सूचनाकतार् नोिटस तामील करायी जा चुकी है, िकतु उनकी ओर से कोई उपिस्थत नहीं है।

आवेदक के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता को सुना तथा पत्रावली का पिरशीलन िकया।

आवेदक के िवद्वान अिधवक्ता ने तकर् प्रस्तुत िकया िक आवेदक को इस प्रकरण में गलत एवं फजीर् ढंग से झूठा फंसाया गया है , उसने किथत अपराध कािरत नहीं िकया है। आवेदक प्रथम सूचना िरपोटर् में नामजद नहीं था और उसका नाम िववेचना के दौरान प्रथम सूचनाकतार् के बयान में प्रकाश में आया है। किथत पीिड़ता के धारा 180 बी.एन.एस.एस. एवं 183 बी.एन.एस.एस. के अंतगर्त दजर् बयानों के अवलोकन से यह स्पष्ट होता है िक उसने अपने बयानों में आवेदक के नाम का खुलासा नहीं िकया और किथत पीिड़ता ने स्वयं अपनी िचिकत्सीय परीक्षण कराने से इनकार कर िदया था, जो संपूणर् अिभयोजन पक्ष की कहानी की असत्यता को दशार्ता है। यह उल्लेख करना भी प्रासंिगक है िक किथत पीिड़ता को आवेदक के संरक्षण या साथ से बरामद नहीं िकया गया था, जो संपूणर् अिभयोजन मामलें के िमथ्यापन को प्रदिशत करता है। आगे यह भी कहा गया िक किथत पीिड़ता द्वारा छोड़े गए किथत पत्र (Note) के अवलोकन मात्र से यह स्पष्ट हो जाता है िक उसने स्वयं अपना पैतृक घर छोड़ा था और आवेदक ने न तो उसे बहलायाफुसलाया और न ही उसके साथ िकसी भी प्रकार का गलत कृत्य िकया। अिभयोजन पक्ष का यह स्वीकृत मामला है िक आवेदक ने किथत पीिड़ता को उसके घर से नहीं बहलाया था और न ही आवेदक ने उसके साथ कोई गलत कायर् िकया। प्रथम सूचना िरपोटर् के संस्करण, तथा धारा

180 बी.एन.एस.एस. एवं 183 बी.एन.एस.एस. के अंतगर्त किथत पीिड़ता के बयानों के बीच महत्वपूणर् अंतिवरोध मौजूद हैं तथा वास्तव में किथत पीिड़ता की िचिकत्सा परीक्षण िरपोटर् अिभयोजन पक्ष के मामले का समथर्न नहीं करती है। इसिलए, आवेदक जमानत पर मुक्त िकये जाने योग्य है। पुनः उनका कथन है िक आवेदक की ओर से यह आश्वासन िदया गया है िक वह कानून की प्रिक्रया में सहयोग करने के िलए तैयार है और जब भी आवश्यकता होगी वह ईमानदारी से अदालत के समक्ष खुद को उपलब्ध कराएगा और उन सभी शतोर्ं को स्वीकार करने के िलए भी तैयार है जो न्यायालय उस पर अिधरोिपत करेगी। आवेदक िनदोर्ष है तथा वह इस प्रकरण में िद० 16.08.2025 से कारागार में िनरुद्ध है। इसिलए , आवेदक को जमानत पर छोड़ िदया जाय।

िवद्वान अपर शासकीय अिधवक्ता ने अिभयुक्त के जमानत का प्रबल िवरोध करते हुए तकर् प्रस्तुत िकया िक अिभयुक्त द्वारा कािरत अपराध स ं ज्ञेय एवं गंभीर प्रकृित का है , इसिलए अिभयुक्त को जमानत पर न छोड़ा जाय।

उभय पक्ष के िवद्वान अिधवक्ता के तकोर्ं के पिरप्रेक्ष्य एवं पत्रावली पर उपलब्ध सारवान तथ्यों एवं पिरिस्थितयों का समग्र रूप से अवलोकन करने के बाद , सबूतों की प्रकृित और िकसी भी ठोस िवरोधात्मक सामग्री की अनुपिस्थित एवं उपलब्ध सामग्री से छेड़छाड़ की संभावना न होने के तथ्य को देखते हुए मेरी राय में आवेदक को जमानत पर मुक्त करने का उपयुक्त आधार है।

अतः वाद के गुण - दोष पर िबना कोई िटप्पणी िकए हुए आवेदक को उपरोक्त विणत अपराध में संबंिधत न्यायालय की संतुिष्ट पर व्यिक्तगत बंध - पत्र एवं अिधक धनरािश के दो स्थानीय प्रितभू प्रस्तुत करने पर िनम्निलिखत शतोर्ं के साथ जमानत पर छोड़ िदया जाय।

आवेदक िववेचना या परीक्षण के दौरान अिभयोजन साक्ष्यों के साथ छेड़छाड़ नहीं करेगा।

आवेदक अिभयोजन सािक्षयों व पीिड़ता / िशकायतकतार् को डरायेगा / धमकायेगा नहीं।

आवेदक न्यायालय के आदेशों का पालन करेगा , वह परीक्षण के दौरान िबना कोई अनावश्यक स्थगन िलए िनयत ितिथ पर न्यायालय में उपिस्थत होगा तथा परीक्षण में ईमानदारी से सहयोग करेगा।

आवेदक जमानत पर िरहा होने के बाद जमानत की स्वतंत्रता का दुरूपयोग नही करेगा और िकसी भी अपरािधक गितिविध में िलप्त नहीं होगा न कोई अपरािधक कृत्य करेगा।

आवेदक प्रत्यक्ष या अप्रत्यक्ष रूप से मामले के तथ्यों से पिरिचत िकसी भी व्यिक्त या पुिलस अिधकािरयों को कोई प्रलोभन या धमकी नहीं देगा न ही उनसे कोई वायदा करेगा
