आवेदक के िवद्वान अिधवक्ता, सूचनाकतार् के िवद्वान अिधवक्ता एवं िवद्वान अपर शासकीय अिधवक्ता को सुना एवं पत्रावली का पिरशीलन िकया।

सूचनाकतार् के िवद्वान अिधवक्ता द्वारा वकालतनामा दािखल िकया गया, इसे पत्रावली पर रखा जाय।

कुछ समय तक तकर् होने के पश्चात् जब न्यायालय द्वारा ossification test के अनुसार पीिड़ता की उम्र के बारे में पूछा गया तो आवेदक के िवद्वान अिधवक्ता ने अवगत कराया िक अभी तक पीिड़ता का ossification test नहीं हुआ है।

िवद्वान अपर शासकीय अिधवक्ता ने आवेदक के िवद्वान अिधवक्ता के इस कथन पर कोई आपित्त नहीं है।

उपरोक्त के दृिष्टगत संबंिधत मुख्य न्याियक मिजस्ट्रेट को िनदेर्िशत िकया जाता है िक मु०अ०सं० 94 सन 2025 अंतगर्त धारा 65(1), 87, 137(2) भारतीय न्याय संिहता व धारा 5L/6 पाक्सो एक्ट, थाना छजलैट, िजला मुरादाबाद की पीिड़ता का ossification test यिद अभी तक संबंिधत मुख्य िचिकत्सािधकारी द्वारा गिठत बोडर् से नहीं कराया गया है तो उसका ossification test आज से 1 सप्ताह के अंदर कराया जाय तथा उक्त टेस्ट कराने के पश्चात या यिद पूवर् में ही ossification test कराया गया हो तो संबंिधत मुख्य न्याियक मिजस्ट्रेट को िनदेर्िशत िकया जाता है िक उक्त ossification report इस न्यायालय में अगली िनयत ितिथ तक उपलब्ध कराया जाय।

रिजस्ट्रार कंप्लायंस को िनदेर्िशत िकया जाता है िक इस आदेश से, संबंिधत मुख्य न्याियक मिजस्ट्रेट को 24 घंटे के अंदर अवगत कराया जाय।
