Sri V.P.Srivastava, learned Senior Advocate assisted by Sri Sudhanshu Trivedi, learned counsel for the applicant and Sri Rajeev Dhar Dwivedi, learned AGA, for the State, are present.

At the very outset, learned senior counsel appearing on behalf of the applicant submits that however, technically this is second bail application filed on behalf of the applicant but first bail application of the applicant has not been dismissed by this Bench on merit and it was dismissed as withdrawn with the liberty to the applicant to file regular bail application before the court concerned for relevant offences and earlier order passed by this Bench has been annexed at page 23 of the paper book.
