Heard Shri Anand Dubey, learned counsel for the applicant, Ms. Meera Tripathi, learned AGA for the State and perused the record.

The second bail application has been filed on behalf of the applicant Suresh Kumar Verma, involved in Case Crime No.-12/2021, U/S406/419/420/467/468/471 I.P.C. Police Station Gomti Nagar, District Lucknow.

The first bail application of the applicant was rejected by the Co-ordinate Bench of this Court vide order dated 5.10.2023 passed in Crl. Misc. Bail Application No.2230 of 2022.

Learned counsel for the applicant submits that till date, no charge has been framed in the case. The applicant is languishing in jail since 8.1.2021. The applicant has also explained his criminal antecedents relating to 12 cases in various paragraphs of the bail application. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail.

Learned A.G.A. opposed the prayer for bail but could not deny the aforesaid facts.

Having considered the fact that the trial is yet to commence and charges have not been framed; the applicant has duly explained his criminal

antecedents relating to 12 cases; the applicant is in judicial custody since 08.01.2024, without entering into the merits of t he case, this Court finds it to be a fit case for enlarging the applicant on bail.

Accordingly, the bail application is allowed.

Let the applicant Suresh Kumar Verma , involved in Case Crime No.12/2021(supra) be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:-

(i) the applicant shall not tamper with the prosecution evidence;

(ii) the applicant shall not pressurize the prosecution witnesses;

(iii) the applicant shall appear on each and every date fixed by the trial Court, either personally or through his counsel.

Any other condition(s) which the trial court/concerned court may deem fit and proper, in the circumstances of the case, may also be imposed.

It is clarified that the observations made in this order are confined to the present bail application and shall have no bearing on the merits of the trial.

Before parting with this order, trial court is directed to expedite the trial.
