Heard Ms. Arti Shukla, learned counsel for the applicant as well as the learned A.G.A. for the State and perused the record.

The applicant has filed this application under Section 483 Cr.P.C. with the following main prayer:

".. direct the court of ACJM III, Room No.19, Sultanpur, to decide the case bearing Criminal Case No.3203/2022, under section 307/504/506/427 I.P.C. (State of U.P. Vs. Sageer and Others) pending in the court of ACJM III, Room No.19, Sultanpur, within the time stipulated by this Hon'ble Court."

Learned counsel for the applicant submits that the aforesaid case is pending since 2022 without substantial progress, hence, a positive direction be given to the trial court to decide the aforesaid case within a stipulated period.

Learned A.G.A. has no objection on the prayer made by the learned counsel for the applicant and submits that a positive direction be given to the trial court to decide the case of the applicant, as merely keeping pending the same by the trial court does not suffice any purpose of the litigation.

In view of the statements made by the learned counsel for the parties, as the matter is of 2022, the trial court is directed to decide the aforesaid case expeditiously, without granting any unnecessary adjournment to either of the parties from the date of filing of the certified copy of this order, unless there is some legal impediment or unless there is any order passed by the

higher court staying the proceedings of the case.

With the aforesaid observation, the application is disposed of finally.
