Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

The present application has been filed for getting a direction issued to Civil Judge (Junior Division), Fast Track Court, Sultanpur (in short "trial Court") to conclude the proceedings of Crl. Misc. Case No. 509 of 2023 (Khan Kaneez Fatima Zaheer Vs. Gufran Khan and Others), filed under Sections 12, 16, 17, 18, 19, 20, 22 of Protection of Women from Domestic Violence Act, 2005, within a time-bound manner.

Learned counsel for the applicant has submitted that the proceedings under Sections 12, 16, 17, 18, 19, 20, 22 of Protection of Women from Domestic Violence Act, 2005 is pending since 20.09.2023, whereas Section 12(5) of the said Act, provides that a case under the Domestic Violence Act, shall be decided within a period of sixty days.

In view of the aforesaid fact, the trial Court is directed to adhere to the provisions of Section 12(5) of the Domestic Violence Act and accordingly take a decision in the matter, expeditiously, in accordance with law, after affording opportunity of hearing to both the parties and without granting any unnecessary adjournments.
