Allahabad High Court, Lucknow Bench (Saurabh Lavania, J.), February 4, 2026 — Application U/S 482 No. 939 of 2026, Ritu Gupta v. State of U.P. and another: the applicant sought setting aside of (i) the order dated 20.06.2025 passed in Criminal Appeal No. 47 of 2025 by the Special Judge, Ayurveda Scam Matters, Lucknow, said to direct initiation of a non-bailable warrant against her, and (ii) the non-bailable warrant order dated 18.07.2025 passed by Additional Court No. 4, Lucknow in Complaint Case No. 1670/2016. At the outset, on account of formal defects, counsel prayed for withdrawal of the application with liberty to file a fresh application with proper prayers, pleadings and documents; the prayer was unopposed. Held: application dismissed as withdrawn with liberty as prayed; office directed to return certified/original copies of the annexed documents to counsel. The instant application has been filed seeking following main relief(s):-

"Wherefore, for the facts, reasons and circumstances stated in the accompanying affidavit, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to set aside the order dated 20.06.2025 passed in Criminal Appeal No. 47 of 2025 (Ritu Gupta Versus State of U.P. and another) which in annexed as. Annex. 1 to this application pending before Learned Special Judge Ayurveda Scam Matters, Lucknow, directing the Learned Magistrate Court to initiate the Non Bailable Warrant against the applicant. Also the NonBailable Warrant order dated 18.07.2025, passed by Learned Additional Court number-4, Lucknow in Complaint Case Number 1670/2016 which is annexed as Annex. 2 to this application against the applicant issued after summoning the same."

On account of some formal defects crept in this application, the learned counsel for the applicant at the very outset prays for withdrawal of this application with liberty to the applicant to file a fresh application with proper prayer(s), pleadings and documents in support thereof.

The aforesaid has not been opposed.

In view of the above, the instant application is dismissed as withdrawn with liberty, as prayed for.

Office is directed to return certified/original copies of the documents annexed with this application to the learned counsel for the applicant as per relevant Rules in this regard.
