Heard Sri Vinay Singh, learned counsel for the applicant and Sri Saurabh Kumar, learned counsel for O.P. No.2, whose Vakalatnama is taken on record.

Learned counsel for the applicant submits that he has filed the instant application under Section 482 Cr.P.C. on the strength of compromise with the relief which has been mentioned in the prayer clause of the application. The relief which has been mentioned in the application is delineated below:-

"WHEREFORE, it is most respectfully prayed that the Charge sheet dated 20-02-2019 of the Case titled as 'The State of U.P. versus Himanshu Yadav and Others', vide Case no. 3548/2020, arising out from FIR / Crime No. 621/2018, under Sections 147/323/506 I.P.C., relating to P.S. Gomtinagar, Lucknow, and also for quashing the impugned Cognizance Order dated 23-01-2020, passed by the Court of Chief Judicial Magistrate, Lucknow, along with all the entire consequential proceedings of the case, so far as related to the Applicant, may kindly be quashed. Counsel It is further prayed that any other relief which this Hon'ble Court deems fit and proper in the facts and circumstances of the case may also kindly be granted to the Applicant."

settled their dispute and arrived at compromise. The compromise deed has been annexed as Annexure 7 to the instant application. They further submit that they want to appear before the trial court for verification of the compromise application.

Accordingly, this application is disposed of with a direction to the trial court concerned that in case compromise deed is produced before it, notices shall be issued to all the signatories to the compromise deed requiring their personal presence and, thereafter, the trial court shall proceed to verify the compromise. After verification of the compromise deed, a report to that effect shall be prepared by the court and the compromise deed will be made part of the record.

The trial court in that scenario will allow the parties to obtain certified copies of the report as well as compromise deed and it will be open to the applicant to approach this Court again for quashing of the proceedings.

For a period of three months, the proceedings of Case No.3548 of 2020 arising out of FIR/Crime No.621 of 2018, under Sections 147, 323, 506 IPC, Police Station Gomtinagar, District Lucknow pending before the court of C.J.M. Lucknow, qua the present applicant, shall remain stayed.

Office is directed to return the certified copies of the documents annexed to this application to the learned counsel for the applicant, after retaining their xerox copies on the record.
