Heard Ms. Shafa Fatima, learned counsel for the applicant and Sri Ajay Kumar Srivastava, learned A.G.A. for the State.

Learned counsel for the applicant submits that he has filed the instant application under Section 482 Cr.P.C. with the relief which has been mentioned in the prayer clause of the application. The relief which has been mentioned in the application is delineated below:-

"Wherefore it is most respectfully prayer that this Hon'ble Court may kindly be pleased to quash the entire proceedings of against impugned Summoning order dated 26.10.2023 passed by the Addl. Chief Judicial Magistrate Court No. 25, Barabanki in case No. 20126/2025, in Crime no. 187/2023, U/S323,504,506,324,308 I.P.C., at Police Station- Masauli, DistrictBarabanki, (State Versus Raghuveer Singh Alias Munni) as well as Charge Sheet No. A171/2023 dated 03.08.2023 are being annexed herewith as Annexure No.1 & 2 respectively to this petition, in the interest of law and Justice. Any other suitable order or direction which this Hon'ble Court may deem fit, just and proper under circumstances of the case may also be passed in favour of the Petitioner."

After arguing at some length, learned counsel for applicant submits that

she does not want to press this application on merits and she further submits that the applicant wants to surrender before the trial court as the offences levelled against him are punishable only upto 7 years and liberty may be given to the applicants to file a bail application before the court of competent jurisdiction.

Learned A.G.A. has no objection if the trial court is directed to decide the application for regular bail of the applicant in terms of decision of the Hon'ble Supreme Court in Satender Kumar Antil Vs. Central Bureau of Investigation and another (2021) 10 SCC 773.

In view of above, the application is disposed of with liberty to the applicant to appear before the concerned trial court and file an appropriate application for regular bail within 30 days from today, which shall be decided by the trial court in the light of decision rendered by Hon'ble Supreme Court in Satender Kumar Antil's case (supra).
