Heard learned counsel for applicant and learned Additional Government Advocate for respondent No.1-State while power on behalf of opposite party No.2 has been filed by Ms. Azmi Yusuf which is taken on record

Petition under Section 528 BNSS has been filed with regard to case crime No. 6 of 2019, under Sections 498A, 323, 504, 506 IPC and 3/4 D.P. Act, P.S. Itaunja, District Lucknow.

Earlier petitioner had filed petition under section 482 Cr.P.C. bearing application No. 2972 of 2026 which was disposed of vide order dated 17th April, 2026 in view of statement made by learned counsel for parties that a compromise had been effected amicably resolving the dispute.

It is in pursuance thereof that a compromise petition was filed before the trial court and has been duly verified by the trial court on 30th April, 2026 with the original being brought on record as annexure No. 2 to this petition.

Learned counsel for the opposite party No.2 also admits the factuam of compromise and its verification.

Learned counsel for the State has no objection to the aforesaid contention.

In view of the above, as the petitioners and opposite parties have entered

into compromise and no grievance remains to be agitated and as such, further criminal proceedings in the aforementioned criminal case are liable to be set aside in view of the Judgements of the Apex Court rendered in B.S. Joshi and others Vs. State of Haryana and another (2003)4 SCC 675; Nikhil Merchant Vs. Central Bureau of Investigation[2008)9 SCC 677]; Manoj Sharma Vs. State and others ( 2008) 16 SCC 1; Gian Singh Vs. State of Punjab (2012) 10 SCC 303; and Narindra Singh and others Vs. State of Punjab ( 2014) 6 SCC 466 .

Accordingly, criminal proceedings with regard to case No. 80710 of 2021, State versus Mohd. Gufran Khan alial Pappoo and another, arising out of case crime number 6 of 2019, under Sections 498A, 323, 504, 506 IPC and 3/4 D.P. Act, P.S. Itaunja, District Lucknow are hereby quashed .

The compromise shall be part of this order.

The application is allowed accordingly.
