Allahabad High Court (Lucknow Bench), Pankaj Bhatia, J. — Application under Section 482 allowed. The entire proceedings of S.T. No.508 of 2025 (State vs Sonu Rajpur), arising out of FIR No.249 of 2024, Police Station Madiyaon, District Lucknow, under Section 3(1) of the U.P. Gangsters and Anti-Social Activities (Prevention) Act, against the applicant Arun Rajput @ Arun, were quashed. On the material placed before the Court, there was no meeting of mind and the provisions of the Rule had not been followed in preparing the gang chart; the Court relied upon its own decision in Nisha vs State of U.P. 2 . The instructions filed by the learned A.G.A. is taken on record.

3 . The present application has been filed seeking to quash the chargesheet filed against the applicant under Section 3 (1) of the U.P. Gangsters and Anti-Social Activities (Prevention) Act.

4 . The submission of the Counsel for the applicant is that while preparing the gang chart, there was no application of mind. Reliance is placed upon the judgment in the case of Sanni Mishra @ Sanjayan Kumar Mishra vs State of U.P. (Criminal Misc. Writ Petition No.16258 of 2023) and in the case of Nisha vs State of U.P. and another: 2025:AHC-LKO:14840 . The Counsel for the applicant also places reliance on the judgment of the Hon'ble Supreme Court in the case of Vinod Bihari Lal vs State of Uttar Pradesh: 2025 INSC 767 .

On the basis of the material placed before this Court, it is clear that there is no meeting of mind and the provisions of the Rule have not been followed, as such, relying upon the judgment of this Court in the case of Nisha vs State of U.P. (Supra) and adopting the same reasoning as contained therein, the entire proceedings of S.T. No.508 of 2025 (State vs Sonu Rajpur) arising out of FIR No.249 of 2024, Police Station Madiyaon, District Lucknow as against the applicant are quashed.
