Heard Ms. Sanya Zaira, Advocate holding brief of Ms. Anjali Singh Tomer, learned counsel for the applicant and Shri Akhilesh Kumar Mishra, learned A.G.A. for the State and perused the record.

Supplementary affidavit dated 22.09.2025, has been filed on behalf of the applicant, which is taken on record.

This application under Section 528 B.N.S.S. has been filed by the applicant to quash entire proceeding of Criminal Case No.13092/IX of 2024 (State of U.P. Vs. Vishal Kumar) arising out of Case Crime No.123 of 2024, under Sections 420, 406, 467, 468 and 471 I.P.C., Police Station Nai Mandi, District- Muzaffar Nagar, as well as charge-sheet dated 25.04.2024 and summoning order dated 05.07.2024, pending in the court of learned Additional Chief Judicial Magistrate, Court No.1, Muzaffar Nagar.

Learned counsel for the applicant submits that applicant and informant have reconciled their differences and a compromise has been entered between them, and original copy of compromise deed dated 07.07.2025 has been annexed as S.A.-1 to the supplementary affidavit. Therefore, no useful purpose would be served in continuing the proceedings before the Trial Court and the same is not only sheer wastage of time of the Court, but also abuse of process of law.

Learned A.G.A. submits that it is the Trial Court which has to verify the fact as to whether the parties have entered into a compromise. Therefore, the applicant may approach the concerned Trial Court and move an application with respect to compromise between the parties, which shall be decided in accordance with law.

Both the parties are directed to appear before the court concerned within three weeks from today for verification of compromise and the court concerned is directed to verify the same.

In case, the same is verified by the Trial Court, a copy of the order of the Trial Court alongwith a copy of compromise duly verified by the Trial Court, be send to this Court within one week, thereafter, so that further action may be taken thereon.

Till verification of compromise or for a period of one month, whichever is earlier, no coercive action shall be taken against the applicants in the aforesaid case.

List this case on 24.07.2026.

Office is directed to return the original compromise to the applicant after retaining the copy of the same, on record.
