प्राथीर् के िवद्वान अिधवक्ता श्री राजेश कुमार कश्यप तथा केन्द्रीय अन्वेषण ब्यूरो के िवद्वान अिधवक्ता श्री अनुराग कुमार िसह को सुना तथा पत्रावली का अवलोकन िकया।

धारा 482 दण्ड प्रिक्रया संिहता के अन्तगर्त प्रस्तुत इस प्राथर्ना पत्र द्वारा प्राथीर् ने प्रथम सूचना िरपोटर् संख्या RC-216 2024 A0009 अन्तगर्त धारा 120-B, 170/419, 420, 468, 471 भा०दं०सं० एवं धारा 66D I.T. Act थाना CBI/AC-1नई िदल्ली जनपद िदल्ली के अनुक्रम में प्रस्तुत आरोप पत्र संख्या 12 िदनांक 12.06.2025 अंतगर्त धारा 120-B, 170/419, 420, 468, 471 भा०दं०सं० एवं धारा 66D I.T. Act तथा उसके आधार पर िवद्वान िवशेष न्याियक मिजस्ट्रेट (प्रदूषण/सी.बी.आई.), लखनऊ द्वारा वाद संख्या 69790 सन 2025 में पािरत आदेश िदनांक 19.12.2015 िजसके द्वारा उपरोक्त अपराध का संज्ञान िलया तथा प्राथीर् को िवचारण हेतु तलब िकया, की वैधता को चुनौती दी गयी है।

िवद्वान अपर शासकीय अिधवक्ता ने उपरोक्त प्राथर्ना-पत्र का िवरोध इस आधार पर िकया है िक धारा 482 दं०प्र०सं० के अंतगर्त क्षेत्रािधकार का उपयोग करते हुए न्यायालय प्राथीर् पर लगाये गये आरोपों की सत्यता को नहीं देख सकती है। न्यायालय को केवल यह देखना है िक पत्रावली पर उपलब्ध प्रपत्रों तथा जांच में संकिलत साक्ष्यों के आधार पर प्राथीर् के िवरुद्ध प्रथम दृष्टया अपराध बनता है या नहीं।

उपरोक्त आदेश की वैधता को चुनौती इस आधार पर दी गयी है िक प्राथीर् के िवरुद्ध लगाये गये आरोप असत्य हैं। माननीय सवोर्च्च न्यायालय के िनणर्य केंद्रीय जांच ब्यूरो बनाम आयर्न िसह आिद, 2023 एससीसी ऑनलाइन एससी 379 में अवधािरत है िक धारा 482 दं०प्र०सं० के अंतगर्त शिक्तयों का उपयोग करते हुए न्यायालय को लघु िवचारण (िमनी ट्रायल) करने की

आवश्यकता नहीं है। इसमें अिभयोजन / जांच एजेंसी को आरोपों को सािबत करने की आवश्यकता नहीं है। दं०प्र०सं० की धारा 482 के अंतगर्त शिक्तयों का उपयोग करते समय न्यायालय के पास बहुत सीिमत अिधकार क्षेत्र है और मात्र यह िवचार करने की आवश्यकता है िक "क्या आरोपी के िवरुद्ध आगे बढ़ने के िलए कोई पयार्प्त सामग्री उपलब्ध है, िजसके िलए आरोपी पर मुकदमा चलाने की आवश्यकता है या नहीं"।

यह प्राथर्ना-पत्र इस िनदेर्श के साथ िनस्तािरत िकया जाता है िक यिद प्राथीर् िवचारण न्यायलय के समक्ष उपिस्थत होकर जमानत पर िरहाई हेतु प्राथर्ना पत्र देता है तो उसे माननीय उच्चतम न्यायालय द्वारा सतेंदर कुमार अंितल बनाम सी.बी.आई., (2021) 10 एससीसी 773 में अवधािरत िविधक िसद्धांतों के आलोक में शीघ्रतापूवर्क िनणीर्त िकया जायेगा।

प्राथर्ना - पत्र तद्नुसार िनस्तािरत िकया जाता है।
