Heard learned counsel for the petitioners, who has filed a supplementary affidavit, which is taken on record.

The instant petition has been preferred seeking expeditious disposal of a Regular Suit No.1755 of 2019 pending before the Civil Judge (Junior Division), Gonda.

The submission of the learned counsel for the petitioners is that the suit is being delayed, however, from the perusal of the record, it indicates that the suit was instituted on 02.07.2019. The order-sheets have been placed only uptil 09.01.2019. Certain extracts of the order-sheets have been brought on record along with the supplementary affidavit filed today which are of the year 2025 and commencing from November, 2025 to February, 2026. There is nothing to indicate as to the cause of delay.

In absence of proper and complete order-sheets, this Court is not inclined to entertain the instant petition, accordingly, it is dismissed , however, leaving it open for the petitioners to move an appropriate application before the Court concerned. In case, such an application is moved needless to say the same shall be considered and pass appropriate order in accordance with law.

It is also made clear that in case if any cause for expediting a suit of the year 2019 arises in future, this order of dismissal may not come in the way of the petitioner.
