यािचकाकतार् की िवद्वान अिधवक्ता श्रीमती ऊषा ितवारी को सुना।

भारतीय संिवधान के अनुच्छेद 227 के अन्तगर्त प्रस्तुत इस यािचका द्वारा यािचकाकतार् ने िवद्वान िसिवल जज (अवर खंड) फैजाबाद/अयोध्या को मूल वाद संख्या 143/2021 (बृषभान ितवारी बनाम िशव प्रसाद और अन्य), के शीघ्र िनस्तारण का िनदेर्श देने का अनुरोध िकया है।

यािचकाकतार् के िवद्वान अिधवक्ता ने कहा िक उन्होंने िवद्वान िसिवल जज को त्रुिटवश यािचका में िवपक्षी बना िदया है तथा उनके मौिखक अनुरोध पर न्यायालय का नाम िवपक्षी के रूप में यािचका से हटाने की अनुमित दी जाती है। यािचका में वाँिछत संशोधन तुरन्त समावोिशत िकया जाए।

मांगे गए अनुरोध एवं पािरत िकए जाने वाले आदेश के दृिष्टगत िवपक्षीगण को नोिटस िनगर्त िकए जाने की कोई आवश्यकता नहीं है।

उपरोक्त मूल वाद यािचकाकतार् ने संिवदा के िविनिदष्ट अनुपालन हेतु वषर् 2021 में प्रस्तुत िकया था। प्रितवादीगण को िनगर्त नोिटस समाचार पत्र में िदनांक 12.04.2022 को प्रकाशन द्वारा उपलब्ध कराई गई है। इसके बाद भी प्रितवादीगण िवचारण न्यायालय के समक्ष उपिस्थत नहीं हुए हैं। यािचका के साथ संलग्न िवचारण न्यायालय के आदेश पत्र की प्रित से प्रतीत होता है िक वाद की सुनवाई अनेक बार िबना िकसी कारण स्थिगत की जाती रही है, इस बीच यािचकाकतार् की अवस्था 60 वषर् की हो गई है।
