Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondents and Sri Ratnesh Chandra, learned counsel for respondent nos.2 to 5.

This petition has been filed with the following main prayers:-

"I. Issue a writ, order or direction in the nature of mandamus commanding the opposite parties to accommodate the petitioner in Sector O and P in place of Plot No.1/172 sector L Kanpur Road Scheme Immediately.

II. Issue a writ order or direction in the nature of mandamus commanding the opposite parties to refund the money deposited by the petitioner towards Kanpur Road Scheme with interest, if delivery of possession of plot to the petitioner is not possible after accommodation in Sector O and P after accommodation."

Learned counsel for the petitioner, at the outset, states that the petitioner does not wish to press Prayer no.II in the relief clause. He only prays that the respondents be directed to accommodate the petitioner in Sector-O and Sector-P in place of Plot No.1/172 allotted to him in Sector-L of Kanpur Road Scheme.

Learned counsel for the petitioner has pointed out that the petitioner was offered such adjustment by letter dated 3.4.2007 issued by the Incharge Officer, Property, a copy of such letter dated 3.4.2007 has been filed as

Sri Ratnesh Chandra, learned counsel appearing on behalf of LDA, has pointed out that only 15 days' time had been given to the petitioner to submit his consent along with copies of all deposit receipts that he had in his possession for the money he had deposited for allotment of plot in Sector-L for which, his application is to be considered for allotment of plot in Sector O and Sector P. It has been submitted that much time has elapsed and he prays that he may be given some time to seek instructions whether the said offer is still open and whether the plots are available in Sector-O and SectorP for adjustment of the petitioner.
