The contention of the petitioner's Counsel is that though the custodial death took place on 20.02.2024 in Pilibhit, but ultimately, the monetary liability to pay compensation is of the State Government stationed at Lucknow. Accordingly, the petitioner has represented to the opposite party no. 1 seeking compensation.
However, before considering the relief prayed for, we would like to have the version of the opposite parties as to whether any Magisterial or other enquiry was conducted in the case of custodial death of the petitioner's son i.e. if it was so.
All pleas including maintainability are kept open.
Let the opposite parties respond to the writ petition within a period of four weeks.
Two weeks thereafter shall be available to the petitioner for filing rejoinder affidavit, if any.
