Heard learned counsel for the petitioner and Shri Vinay Shankar, learned counsel for the respondent-Bank.

The present petition has been filed by the petitioner challenging the action of the respondent-Bank in recovering the amount against the petitioner.

Learned counsel for the respondent-Bank, based upon the instructions, states that an amount of Rs. 10,40,559/- is due and payable by the petitioner along with accrued interest.

Learned counsel for the petitioner states that the petitioner is ready and willing to pay the amount, however, seeks sometime to pay the same.

In view thereof, it is directed that the recovery against the petitioner shall remain in abeyance, subject to the petitioner depositing an amount of Rs. 1,00,000/- (One lakh) with the respondent-Bank on or before 30th June, 2025. The balance amount of about Rs. 9,40,000/- shall be paid by the petitioner in five quarterly installments of Rs. 1,80,000/- each. The first installment shall be payable on or before 30th September, 2025, the second by 31st December, 2025, the third by 31st March, 2026, the fourth by 30th June, 2026 and the last installment by 30th September, 2026. The last installment shall include the overdue interests.

In the event of failure to pay of any of the installments as directed above, the respondent-Bank would be at liberty to recover the amount in accordance with law.

It is further directed that in case, any beneficiary scheme is launched by the Bank, the petitioner would be entitled to get the benefit of the said scheme.

It is further provided that in case, the installments are paid as

directed above, no recovery charges shall be levelled against the petitioner.

The writ petition stands disposed of with the above terms.
