Heard learned counsel for the petitioner and learned Standing Counsel for the State.

The present writ petition is filed with the following prayer :-

" a) Issue writ order or direction in the nature of mandamus commanding and directing the respondent no. 2 UpZiladhikari/Up-Zila Magistrate, Sagari, Azamgarh to decide the Case No. 9861/2023, Computer Case No. T202315060709861 (Report Vs. Suresh and others) under Section 4 of U.P. The Public Premises (Eviction of Unauthorised Occupants) Act 1972. "

Learned counsel for the petitioner submits that public road has been encroached upon in respect of which proceedings are going on under the U.P. Public Premises (Eviction of Unauthorised Occupants) Act, 1972. The petitioner is the complainant and the direction may be issued to conclude the proceedings in a time bound manner.

Learned Standing Counsel for the respondent-State submits that proceedings would be concluded in a time bound manner.

Considering the facts and circumstances of the case, it is hereby directed that proceedings going on under the U.P. Public Premises (Eviction of Unauthorised Occupants) Act, 1972 pending before respondent No.2 be concluded expeditiously, preferably within a period of four months from the date of production of a certified copy of this order.

With the aforesaid observation/direction, the writ petition stands disposed of.
