Sri Shailendra Kumar Upadhyay, Advocate has filed Vakalatnama on behalf of respondent no.4 today, which is taken on record.

Heard learned counsel for the petitioner, learned Standing Counsel for respondent nos.1 to 3 and Sri Shailendra Kumar Upadhyay, learned counsel for respondent no.4.

The petitioner by means of the present writ petition has assailed the show cause notice dated 09.12.2024 and 23.12.2024 issued by the Joint Director of Education, Bareilly Region, Bareilly on two grounds; firstly, the Joint Director of Education has no jurisdiction to issue such notice, and secondly, the respondent no.4 is not the member of the Society as well as electoral college, therefore, he has no locus to file the complaint.

The impugned notice is only show cause notice, and both the aforesaid contention can be raised by the petitioner in his objection before the respondent no.2.

Accordingly, the writ petition is disposed off with a direction to the respondent no.2-Joint Director of Education, Bareilly Region, Bareilly to record the aforesaid two contentions raised by the petitioner besides other objections raised by the petitioner in his objection against the show cause notice while deciding the dispute.
