"1. The contention of the learned counsel for the petitioner is that the order impugned has been passed directing the Committee of Management to remove its Secretary in view of certain inquiry that was conducted on the direction of the respondent no.3. It is stated that in view of the judgment of this Court in the case of Committee of Management, Grih Laxmi Sahkari Awas Samiti Ltd. & Ors. vs. State of U.P. & Ors. reported in 2024 (9) ADJ 400 (DB) , the respondent no.3, before making such a direction as made in the impugned order, has to supply the relevant material to the Society on the basis of which the Society can confront the Secretary at the time of meeting convened for purpose as envisaged in Section 38 of the U.P. Cooperative Societies Act, 1965."
