Heard learned counsel for the petitioner and learned Standing Counsel for respondents.

The petitioner by means of the present writ petition has prayed for the following relief:

"(i) Issue a writ, order or direction in the nature of mandamus directing the respondent authorities particularly respondent no.3 to grant permission to the petitioner to run his saw mill from old place at Gate No.418 Ka to newly place at Gata No.14/1 situated at Tajpur, Naukasta, Tehsil-Gursahaiganj, District Kannauj.

(ii) issue a writ, order or direction in the nature of mandamus directing the respondent no.3 to decide the online transfer application dated 27.06.2025 within stipulated and reasonable period.

(iii) issue any other suitable writ, order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the case.

(iv) Award cost of the writ petition in favour of the petitioner."

The brief facts of the case are that the petitioner is running a saw mill at Gata No.418-Ka situated in Mohalla Majhpura, Gursahaiganj, District Kannauj in the joint land of the petitioner as well as his brother. A family partition took place between the petitioner and his real brother, therefore, the land on which the petitioner was running his saw mill was not found to be sufficient, due to which the petitioner took a rented plot for running his saw mill at Gata No.14/1 Area Tajpur, Naukasta Tehsil, District Kannauj, and a rent agreement was also executed between the petitioner and one Mushtaq

Ahmad on 20.05.2024. Thereafter, the petitioner moved online application to obtain permit to change place of saw mill from Gata No.418Ka to Gata No.14/1 situated at Tajpur, Naukasta,, Tehsil Gursahaiganj, District Kannauj along with renewal certificate on 27.06.2025, which is still pending and no action has yet been taken on the same.

Learned Standing Counsel for the respondents submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to the respondent no.3.

Accordingly, considering the facts and circumstances of the case and without going into the merits of the case, the writ petition is disposed off permitting the petitioner to submit a fresh representation before the respondent no.3-District Forest Officer (DFO)), Kannauj along with a certified copy of this order within a period of one month from today. In case any such representation is filed by the petitioner, the respondent no.3 shall consider and decide the same by a reasoned and speaking order preferably within a period of two months thereafter after giving due notice and opportunity of hearing to the petitioner.
