Allahabad High Court (Division Bench of Neeraj Tiwari and Vivek Kumar Singh, JJ.) dismissed Writ - C No. 40201 of 2024 (Dhotre Shakshi Dilip and 43 others v. Union of India and 8 others) by order dated October 9, 2025. At the outset, counsel for the petitioners informed the Court that vide order dated 16.01.2024 relief had already been granted to Glocal College of Ayurvedic Medical Science & Research Centre, Delhi, and prayed that the petition be dismissed with liberty to approach the National Commission for Indian System of Medicine ('Commission') for the same relief. The Court dismissed the petition and observed that it is always open to the petitioners to approach the competent authority for redressal of their grievance and that no order of the Court was required for that purpose. Heard learned counsel for the petitioners, Sri Vinay Kumar Singh, learned counsel for respondent no. 1, Sri Ashish Kumar Ojha, learned counsel for respondent nos. 2 & 3, learned standing counsel for respondent nos. 4, 5 & 6, Sri Bal Mukund Singh, learned counsel for respondent nos. 7 & 8 and Sri Some Narayan Mishra, learned counsel for respondent no. 9.

At the very outset, it is informed that earlier respondent no. 9 has also approached this Court for almost same relief by filing Writ C No.34736 of 2022, which was dismissed vide order dated 3.3.2023. Against the said order, respondent no. 9 has preferred SLP before Apex Court, which was disposed of vide order dated 01.12.2023 with direction to respondent no. 2- National Commission for Indian System of Medicine, Ministry of Ayush, Govt. of India, New Delhi (hereinafter referred to as "Commission") to consider the representation of petitioner and decide the same within six weeks.

Sri Some Narayan Mishra, learned counsel for respondent no. 9 informed that in compliance of order of Apex Court, he has filed representation before Commission, which was rejected vide order dated 09.05.20204. Against the said order, respondent no. 9 has preferred appeal under Section 9 of National Commission for Indian System of Medicine Act, 2020, which is still pending for adjudication.

At this stage, learned counsel for the petitioners informed that vide order dated 16.01.2024, relief has been granted to Glocal College of Ayurvedic Medical Science & Research Centre, Delhi, therefore, petition may be dismissed with liberty to approach Commission for seeking relief, which is granted to Glocal College of Ayurvedic Medical Science & Research Centre, Delhi.

Under such facts of the case, petition is dismissed .

So far as liberty is concerned, it is always open to the petitioners to approach competent authority for redressal of their grievance and for that no order is required from the Court.
