Heard Sri Arun Mishra, learned counsel for the petitioners and Shri Munna Pandey, holding brief of Sri Harshit Pandey, learned counsel appearing for respondent no.2 and Sri Devesh Vikram, learned Additional Chief Standing Counsel for State-respondent.

The instant writ petition has been preferred praying inter alia for the following relief :-

"i. Issue a writ of Certiorari quashing Notice dated 27.09.25 (Annexure 3) issued by respondent No. 2 U/s 26(ka)(4) as the same is issued without any legal force."

Learned counsel for the respondent, at the outset, has raised an objection qua the maintainability of the instant writ petition on the premise that earlier on, petitioner had preferred Writ-C No.47947 of 2014 titled as "Smt. Noreen Chattree and two others Vs. State of U.P. and another" which was listed under the heading "Oldest Pending Cases in this High Court for Priority Hearing". As the petitioner had not turned up on the said date, consequently, co-ordinate Bench of this Court dismissed the aforesaid petition on 29.07.2025 and the matter was consigned to record as no cause of action survived. However, leave was accorded to the petitioner to move an application within a reasonable time.

Also an objection is being raised that the petitioner's lease has not been renewed till date, therefore any alleged claim set up for construction over

the said land is per se unsustainable.

Confronted with this situation, Sri Arun Mishra, learned counsel for the petitioner fairly submits that the instant writ petition may be dismissed as not pressed and leave may be accorded to press the restoration application and other ancillary relief in the pending writ petition.

With the aforesaid leave, the instant writ petition is dismissed as not pressed.
