Heard learned counsel for the petitioner; learned Standing Counsel for State respondent and Shri Kaushalendra Nath Singh, earned counsel for New Okhla Industrial Development Authority (in short "Authority").

The instant writ petition has been preferred for following reliefs:-

"A. Issue a writ, order in the nature of mandamus commanding and directing to the respondent authority to consider the grievance of the petitioner for transferring the vending license in the name of the petitioner as the petitioner is the legal heir of her husband late Raj Kumar.

B. Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent authorities not to harass the petitioner for squatting the petty shop at her specified place mentioned in the allotment letter of control no.1770...."

Learned counsel for the petitioner precisely submits that the claim of the petitioner is sustainable and liable to be considered in the light of Section 5 (2) of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 (in short "Act, 2014"), which provides that where a street vendor to whom a certificate of vending is issued dies or suffer from any permanent disability or is ill, one of his family member in following order of priority, may vend in his place, till the validity of the certificate of vending-(a) spouse of the street vendor; (b) dependent child of the street vendor. It is submitted that petitioner is wife of deceased vendor and as such she is entitled for vending in his place till the validity of the certificate of

vending. He submits that Redressal Grievance Committee constituted under the Act, 2014 may be directed to redress the grievance of the petitioner in accordance with law.

Considering the facts and circumstances of the case, without expressing any opinion on merits of the issue, the writ petition stands disposed of asking the authority concerned to look into, examine and redress the grievance of the petitioner in accordance with law expeditiously and preferably within three weeks from the date of production of certified copy of this order.
