The instant writ petition has been filed with the following prayers:-

(a) Issue a Writ, order or direction in the nature of mandamus directing the Vice Chancellor to recognize the elections dated 18.2.2025 of petitioner's Committee of Management and attest the signature of the petitioner as Manager of the institution.

(b) Issue a Writ, order or direction in the nature of Mandamus directing the Vice Chancellor (Respondent No. 3) to decide the petitioner's representation dated 18.4.2025 and 16.5.2025 for recognizing the petitioner's Committee Management and attesting the petitioner's signature of as Manager of the Institution (Annexure No. 3 and 4 to this writ petition).

Learned counsel appearing on behalf of petitioner after some length of argument without entering into the merits of the case made innocuous prayer that respondent no. 3 - Vice Chancellor, Mahatama Gandhi Kashi Vidyapeeth, District Varanasi may be directed to decide his representation in time bound manner.

3.. Sri Shashi Prakash, learned counsel appearing on behalf of respondent no. 3 and 4 vehemently opposed the petition on merit, but he has not opposed the prayer as made by learned counsel appearing on behalf of the petitioner.

Heard learned counsel appearing on behalf of the petitioner and Sri L.P. Srivastava, learned Standing Counsel and Sri Shashi Prakash, learned counsel appearing on behalf of respondent nos. 3

and 4 and perused the contents made in the writ petition.

Without entering into merits of the case, I am inclined to allow the innocuous prayer made by learned counsel appearing on behalf of the petitioner as no objection made by learned counsel for respondent nos. 3 and 4, the petitioner is directed to file a fresh detailed representation along with the present writ petition and certified copy of this order before respondent no. 3 within 10 days. After receiving the said representation, the respondent no. 3 is directed to decide the said representation in accordance with law, expeditiously, preferably within a period of eight weeks from the date of receipt of the said representation.

With the aforesaid directions/observations, the present writ petition is disposed of.
