Heard learned counsel for petitioner and Sri Abhishek Ahuja, learned counsel for respondent no. 2.

This writ petition has been filed with the following prayer;

"Issue a Writ or direction in suitable Nature Directing to the Respondent no.1 to decide the APPEAL DY.No.1121 of 2024 "Indian Bank Vs. M/s.Raj Textiles and another" filed by the Respondent no.2/Appellant Bank as early as Possible within stipulated Period, and/or pass such others and further order which this Hon'ble Court may deem fit and proper under the circumstances of the present case, during the pendency of the present Wirt petition before this Hon'ble Court."

It is contended by learned counsel for the petitioner that Appeal DY. No. 1121 of 2024 is pending consideration before the Debts Recovery Appellate Tribunal, Prayagraj. The sole prayer made in writ petition for expeditious disposal of the same.

As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed off, at the admission stage, without calling for counter affidavit or issuing notice to private respondent, with a request to Chairperson, Debts Recovery Appellate Tribunal, Prayagraj to decide the Appeal DY. No. 1121 of 2024, in accordance with law, after hearing all affected parties, preferably within a period of six months from the date of production of certified copy of this order.

With the aforesaid directions, writ petition stands disposed off.

It is made clear that this Court has not adjudicated the matter on merits.
