1. The prayer made in the instant petition is for a direction to the respondent Authority to grant Functional Certificate to the petitioner and take decision on its representation dated 28.08.2024. The petitioner is allottee of Plot No. HS-1, Sector 3, Greater Noida.

The case of the petitioner is that the petitioner has established the school as per the terms of the allotment letter but the respondents have failed to issue Functional Certificate to the petitioner despite repeated representations. It is submitted that the representation dated 28.08.2024 be directed to be decided within a specific time frame.

3. Ms. Anjali Upadhyay, learned counsel for the respondent Development Authority has invited our attention towards a notice dated 19.06.2019 whereby a demand for deposit of Rs. 53,76,000/has been made from the petitioner towards penalty calculated @ 4 % of the total premium per year.

4. She submits that the respondent Authority will ascertain whether the said amount has been deposited or not and will take decision accordingly.

5. Learned counsel for the petitioner submits that the petitioner has filed objection against the demand notice dated 19.06.2019 and it is pending.

6. Having regard to the same, we dispose of the instant petition

with direction to the respondent Authority to take decision in the matter within eight weeks from the date of communication of the instant order having due regard to the objection filed by the petitioner against the demand notice dated 19.06.2019.
