We have heard learned counsel for the petitioner, learned Standing Counsel for the State Respondents and Sri Akhilesh Kumar Srivastava, Advocate who has filed his vakalatnama on behalf of the Opposite Party No.4/Lucknow Development Authority, which is taken on record.

This writ petition has been filed with the following main prayers:-

"(i) Issue a writ, order or direction in the nature of Mandamus opposite parties to Commanding ensure the the compliance of the order dated 06.03.2000 passed by L.D.A. and the order dated 15.10.2025 passed by the L.D.A. within stipulated period contained as annexure No. 2 in the interest of justice.

(ii) To issue writ order or other any direction which this Hon'ble Court deems fit and proper under the circumstance of the case in the interest of justice."

It is the case of the petitioner that the Prescribed Authority, i.e. Lucknow Development Authority, in Case No. 1296 of 1995 had passed an order against the private respondent directing demolition of illegal construction way back on 17.08.1996. Appeal and Revision were dismissed, even the writ petition filed by the private respondent Misc. Writ Petition No. 4330(M/S) of 2006 (Arvind Kumar Shukla Vs. State of U.P. and Others) was dismissed on 23.07.2019 and the Court also

observed that interim order, if any, shall stand vacated.

It has been submitted that till date the order passed by the Prescribed Authority has not been complied with.

Sri Akhilesh Kumar Srivastava, learned counsel for the opposite party no.4 shall seek instructions.
