Heard learned counsel for the petitioner and learned Standing Counsel, who appears on behalf of State-Respondents.

This petition has been filed with the following main prayer :

"Issue a Writ order or direction in the nature of Mandamus there by commanding to the Opposite party No. 3 Superintendent of Police Bahraich, District Bahraich to take decision upon the application 26.05.2025 pending before him with a stipulated period fixed by this Hon'ble Court in the interest of justice."

On going through the representation dated 26.05.2025, we find that the petitioner wants to sell meat of large animals, for which he has applied for the grant of a licence. He has stated that the neighbourhood adjacent to the meat shop has a Muslim population and nobody is objecting to the same and the application moved for obtaining a No Objection Certificate from the police has not been processed. Hence, this petition has been filed.

Learned Standing Counsel, on the basis of instructions, states that the area where the petitioner proposes to set up a meat shop has a mixed population of Hindu and Muslim communities and since the meat shop will be selling meat of large animals, there is a likelihood of disturbance of law and order. Therefore, an adverse report has been sent by the police station concerned.

Learned counsel for the petitioner submits that other meat shops are running in the very area in which the petitioner proposes to set up the meat shop and

nothing has been done by the police or any other authority with regard to such already operating meat shops.

Let a short counter affidavit be filed by respondent no. 3, Superintendent of Police, Bahraich with regard to the statement made by learned counsel for the petitioner concerning other similar meat shops running in the area where the petitioner proposes to set up the meat shop.

Respondent no.3, Superintendent of Police, Bahraich shall get an enquiry conducted in the matter and also take clear photographs, which shall form part of the short counter affidavit.
