यािचकाकतार् के िवद्वान अिधवक्ता श्री ईश्वर दत्त शुक्ला तथा िवपक्षीगण की तरफ से राज्य सरकार के िवद्वान स्थायी अिधवक्ता श्री संदीप श्रीवास्तव को सुना तथा पत्रावली का अवलोकन िकया।

इस यािचका द्वारा यािचकाकतार् ने क्षेत्रीय उच्च िशक्षा अिधकारी, लखनऊ द्वारा पािरत आदेश िदनांक 30.09.2025 की वैधता को चुनौती दी है, िजसके माध्यम से नेपाल िसह महा िवद्यालय की स्थापना के िलए रुपये 10 लाख की दो िकस्तों में अवमुक्त धनरािश कुल रूपये 20 लाख का उपभोग प्रमाण-पत्र उपलब्ध न कराये जाने के कारण उक्त धनरािश पर ब्याज जोड़ते हुए कुल रुपये 1,12,87,420/- (रुपये एक करोड़, बारह लाख, सत्तासी हजार, चार सौ बीस मात्र) की वसूली करने का िनदेर्श िदया गया है।

यािचकाकतार् के िवद्वान अिधवक्ता ने तकर् िदया िक रुपये 10 लाख की िकस्त िमलने पर यािचकाकतार्गण ने उक्त का उपभोग कर िलया था तथा क्षेत्रीय उच्च िशक्षा अिधकारी, लखनऊ ने िशक्षा िनदेशक (उच्च िशक्षा) को प्रेिषत पत्र िदनांक 16.06.2014 में इसका उल्लेख िकया था।

क्षेत्रीय उच्च िशक्षा अिधकारी के पत्र िदनांक 14.09.2018 में अंिकत है िक शासन द्वारा कुल स्वीकृत धनरािश कुल रुपये 20 लाख के सापेक्ष महािवद्यालय के िनमार्ण में लगभग एक करोड़ की धनरािश व् य की जा चुकी है।

यािचकाकतार्गण के िवद्वान अिधवक्ता का तकर् है िक क्षेत्रीय उच्च िशक्षा अिधकारी के उपरोक्त पत्रों िदनांक 16.06.2014 एवं िदनांक 14.09.2018 से स्पष्ट है िक अनुदान के रूप में दो िकश्तों में िदये गये रुपये 20 लाख के सापेक्ष यािचकाकतार्गण महािवद्यालय के भवन िनमार्ण में एक करोड़ से अिधक रुपया खचर् कर चुके थे।

ऐसी िस्थित में धनरािश का उपभोग न होने के कारण वसूली का कोई औिचत्य नहीं है।

प्रकरण की िवस्तृत समीक्षा की आवश्यकता प्रतीत होती है।

िवपक्षीगण चार सप्ताह में प्रितशपथ-पत्र प्रस्तुत कर सकते हैं।

प्रत्युत्तर शपथ-पत्र यिद आवश्यक हो उसके उपरान्त दो सप्ताह में प्रस्तुत िकया जा सकता है।
