1 . Heard learned Counsel for the petitioner as well as learned Standing Counsel and learned Counsel for the substituted heir of respondent no.2.

2 . The present petition has been filed challenging an award dated 03.10.2018 whereby, the respondent no.2, while he was surviving, was granted an award of reinstatement with backwages.

3 . When the petition was filed, this Court while granting interim order on 16.04.2019 had directed for payment of Rs.1,50,000/- before this Court and the said amount was directed to be deposited in interest bearing account. During the pendency of the writ petition, the contesting respondent no.2 died and has been substituted by his legal heir.

4 . The Counsel for the petitioner argues that the award impugned is illegal as per Section 4-k of the U.P. Industrial Disputes Act.

5. The Counsel for the legal heir of the respondent no.2 agrees that the amount of Rs.1,50,000/- deposited before this Court, along with the accrued interest thereon may be paid to him towards full and final settlement of his claim.

6 . In view thereof, the present writ petition is disposed off holding that the

amount of Rs.1,50,000/- along with the accrued interest in pursuance to the interim order dated 16.04.2019 shall be paid to the legal heir of the respondent no.2 on his moving an appropriate application.

7 . The award impugned stands satisfied in terms of the order passed hereinabove.
