This petition has been filed with the following prayers :-

(i) issue a writ, order or direction in the nature of certiorari to thereby quash the impugned order dated 12.09.2025 passed by the opposite party no.4 (Secretary, Krishi utpadan Mandi Samiti, Lakhimpur Kheri) contained as Annexure No.2 to the writ petition inthe interest of justice.

(ii) Issue a writ, order or direction in the nature of mandamus commanding the respondents/ authorities concerned not to interfere in the lawful business of the petitioner and permit the petitioner to continue to carry on his trading activities under the said license in the interest of justice.

(iii) issue a writ, order or direction in the nature of mandamus commanding the opposite party not to interfere in the lawful business of the petitioner and to restore his licence forthwith in the interest of justice."

The preliminary objection has been made regarding maintainability of the petition on the ground that there is a provision of filing appeal.

Learned counsel for the petitioner states that in this case the order impugned has been passed by an incompetent authority. He has also

stated that principles of natural justice has not been followed.

Learned counsel appearing on behalf of Mandi Parishad shall seek specific instructions as to whether notice was issued to the petitioner. He shall also seek instructions as to whether the Committee had passed any resolution on the basis of which the Secretary of the Samiti has communicated the order impugned.
