Heard Sri Ashish Raman Mishra, learned counsel for the petitioner and Sri Dev Prakash Mishra, learned Additional Chief Standing Counsel for the State.

Present petition has been filed for quashing the impugned orders dated 29.03.2025 passed by opposite party no.1 in Case No.61 of 2018 so far as it relates to the Revision No.35/ 2018530815000090 (Makbool Khan and others vs Department of Forest), under Section 48(1) of U.P. Consolidation of Holding Act, impugned order dated 21.02.2018 passed by opposite party no.2 under Section 11(1) of U.P. Consolidation of Holding Act so far as it relates to the Appeal No.209/ 2017540815000018 (Makbool Khan and others vs Department of Forest) and order dated 17.06.2016 passed by opposite party no.3 under Section 9(A)2 of U.P. Consolidation of Holding Act in Case No.107 and 1601 to 1611 Department of Forest vs Naushad).

Contention of learned counsel for the petitioner is that while passing the impugned order, the court below has failed to consider, Bhigu was revisionist in revision no.1 but the DDC merely on the ground that legal heir of Bhigu was not substituted not only dismissed the revision no.1 but also revision no.2 and 35 though Bighu was neither the revisionist nor the opposite party, therefore, the impugned order is absolutely erroneous so far the revision No.2 and 35 are concerned.
