The instant writ petition has been seeking for the following reliefs.

"(1) issue a writ, order or direction in the nature of certiorari quashing the impugned retiral notice dated 14.2.2025 (Annexure No.24 to the writ petition).

(II) issue a writ, order or direction in the nature of certiorari quashing the decision of the Executive Council dated 8.3.2019 by means of which without assigning any reason the office order dated 1.12.2009 issued by the Acting Registrar, in terms of resolution No. 32/12 dated 29.10.2009 of the Executive Council on the basis of representation of screening committee dated 30.11.2009 was rescinded (Annexure No. 19 to the writ petition).

(III) issue a writ, order or direction in the nature of certiorari quashing the recovery letter cum notice dated 2.12.2024 issued by Finance Officer, University of Allahabad, Allahabad respondent No.3 (Annexure No.22 to the writ petition).

(IV) issue a writ, order or direction of suitable nature restraining the respondents from retiring the petitioner in pursuance to the impugned retiral notice dated 14.2.2025 (Annexure No.24 to the writ petition."

Sri Kunal Ravi Singh, learned counsel appearing on behalf of respondents has taken preliminary objection on the maintainability of the instant writ petition and submitted that retiral notice dated 14.02.2025 and order dated 08.03.2019 of Executive Council have been challenged in the instant writ petition which is not maintainable as per Section 10 (11) of the University of Allahabad Act, 2005.

At this juncture, Sri Somesh Khare holding brief of Sri Yashwant Singh, learned counsel appearing on behalf of petitioner has fairly conceded the submissions raised by learned counsel for the respondents and submitted that he may be permitted to

approach the Visitor of University by way of filing appropriate application under Section 10(11) of the University of Allahabad Act, 2005.

Taking into consideration the preliminary objection raised by learned counsel for the respondents and consent given by learned counsel for the petitioner, I am inclined to dispose of the instant writ petition with direction to petitioner to approach the concerned authority within four weeks.

Accordingly, the instant petition is disposed of.
