Heard Sri Prabhakar Awasthi, learned Senior Counsel assisted by Sri Saurabh Tripathi, learned counsel for the petitioner. Learned Standing Counsel has accepted notice on behalf of respondent-State.

The petitioner has preferred present writ petition inter-alia with the following prayer :-

"i. Issue a writ, order or direction in the nature of Mandamus commanding the District Basic Education Officer, Ghaziabad to forthwith ensure payment of arrears of salary from 15.01.2019 to 21.07.2023, a period of four years, six months and sixteen days to be ensured within stipulated period of time, if need so arises, by way of reasoned speaking order, on the request/representation of the petitioner dated 22.02.2024 & 06.12.2024."

It is argued by counsel for the petitioner that earlier petitioner filed a petition being Writ A No.4958 of 2021 connected along-with Writ A No.11711 of 2022 file by one Sonika. Both the writ petitions were clubbed together vide judgement and order dated 27.07.2021. Pursuant to the aforesaid an order dated 25.07.2023 was passed by the District Basic Education Officer, Muzaffar Nagar/respondent no.4. The operative portion of which reads as follows :-

"माननीय उच्च न्यायालय इलाहाबाद द्वारा पािरत िनणर्य के अनुपालन में पत्रावली के अनुशीलन याचीगण, का पक्ष सुनने के उपरान्त एवं उपयुर्क्त समीक्षा के आधार पर यह स्पष्ट होता है िक श्री गुरू नानक जूिनयर हाई स्कूल भूड खतौली में तीन अध्यािपकाओं श्रीमित पल्लवी, सोिनका

एवं सपना की िनयुिक्त का अनुमोदन तत्कालीन िजला बेिसक िशक्षा अिधकारी द्वारा िदनांक 09.01.2019 को िकया गया। चयिनत एवं अनुमोिदत अध्यािपकाओं को इस प्रितबंध के साथ वेतन भुगतान की अनुमित प्रदान की जाती है िक यिद इस सम्बन्ध में मा० न्यायालय/िवभाग द्वारा कोई िवपरीत आदेश पािरत िकया जाता है अथवा कोई िवपरीत तथ्य प्रकाश में आता है तो यह अनुमित स्वतः िनरस्त समझी जाएगी।

याचीगण के प्रत्यावेदन एतद्वारा िनस्तािरत िकए जाते हैं।"

It is further argued that the other petitioner namely Sonika preferred a petition being Writ A No.9414 of 2025 for compliance of aforesaid order and ultimately arrears of salary has been make in favour of Sonika by respondent no.4. It is further argued that case of the petitioner is absolutely identical as the case of Sonika.

In this view of the matter, a prayer has been made to direct the respondent no.4 to make the payment of salary to the petitioner expeditiously.

On the other hand it is argued by learned Standing Counsel that respondent no.4 will consider the matter of the petitioner and pass appropriate orders expeditiously.

Heard learned counsel for the parties and perused the records.

In the facts and circumstances, the petitioner is permitted to submit a fresh representation ventilating all his grievances before the respondent no.4 along-with certified copy of this order within a period of three weeks from today. If such a representation is made, the respondent no.4 is directed to pass appropriate order in accordance with law within a further period of six weeks.

With the aforesaid observations, present writ petition is disposed of finally.
